How can you avoid getting a ticket for excessive window tinting?

Are you considering having your car windows tinted to help shield you and your family from the scorching North Carolina summer heat? Do you just want a little more privacy while you're driving on crowded roads? Maybe you have a medical condition that increases your photosensitivity or makes it necessary to reduce the glare and/or heat in your vehicle.

Whatever the reason, if you add tint to your vehicle's windows, it's essential to know that North Carolina, like other states, has regulations governing how dark and how extensive it can be. The tint can't extend further than 5 inches down the windshield. The tint also can't exceed 32% visible light transmission (VLT). If your tinting doesn't meet those requirements, you can be issued a ticket.

There are exceptions. As noted, you may be able to get a medical waiver. Your doctor would need to complete a Tinted Window Waiver Application Form, and it needs to be approved by the North Carolina Division of Motor Vehicles. With a waiver, you may be able to get a tint of up to 70% VLT. You need to display your medical waiver sticker on your rear window to avoid a costly citation.

There are other exceptions. For example, motor homes, limousines, ambulances and some specialized law enforcement vehicles can have darker tinting.

Before you have that extra tinting added to your car, make sure that it meets the legal requirements. If you need added tinting due to a medical condition (either yours or a family member's), be sure that you get the necessary permit and that you display it properly on your vehicle(s).

If you believe that you were wrongfully cited for having excessive tinting, it may be wise to consult with an attorney to find out what your options are for fighting the citation.
